The purpose of this Privacy Policy is to inform the data subjects whose personal data is being collected of the specific aspects relating to the processing of their data, including, among other things, the purposes of the processing, the contact details for exercising their rights, the periods for which the information is retained and the security measures, among other matters.

When you identify yourself as a Club member in a purchase made through HABITUS GLOBAL RETAIL, S.L.U. will process your Club data on behalf of HABITUS GLOBAL, S.L., in its capacity as data processor.

3. Type of data we will process

We inform you that the categories of data we may process are defined below: 
  • Identification and contact data: name, postal addresses, telephone numbers, email addresses, national identity card or passport number, as well as details of your social media profiles and other identification and contact data that may be necessary for the purposes set out in this policy.
  • Professional Data: for managing the CV. 
  • Purchase Data: Order number, details of the items purchased or service commissioned, details of the payment method used, delivery and billing addresses, messages and direct communications related to the purchase and performance of the service.
  • Payment Data: billing addresses, credit card details
  • Data relating to website use: When you interact with our website as described in the cookie policy.
  • Social Media: If you use social media, the social media operators determine the nature, scope and purposes of processing the data on those platforms.
  • Image: based on video surveillance cameras.

Any personal data requested, where applicable, will consist solely of data that is strictly necessary to identify and address the request made by the data subject, hereinafter referred to as the interested party. This information will be processed fairly, lawfully and transparently in relation to the interested party. If the processing results from the exercise of data subjects' rights or from complaints relating to the controller's products or services, the legal basis will be compliance with our legal obligations. (Article 6.1(c) GDPR)

If the processing concerns the management of incidents related to the purchased product, the processing will be necessary for the performance of the sales contract.

Marketing and Newsletter

7. Data retention period

As a general rule, we store your personal data for as long as necessary to fulfill the purpose for which it was collected, and according to the legal basis for processing it in accordance with applicable law. We will retain your personal information while a contractual and/or business relationship exists with you, or while you do not exercise your right to erasure or restriction of the processing of your data. In these cases, we will keep the information duly blocked, without using it for any purpose, for as long as it may be necessary to exercise or defend against claims or as long as any judicial, legal or contractual liability may arise from its processing that must be addressed and for which its processing is necessary.

In France, data will be retained for 3 years from the last interaction, purchase, login or contact with us, unless there is a legal obligation to retain it for longer or you exercise your rights; once this period has elapsed, your data will be deleted or anonymized, without affecting your membership card: simply reactivating it will resume the count.

 
In Italy, data processed with your consent for marketing purposes is retained for a maximum of 1 year from its collection or from the last interaction; data processed for profiling purposes is retained for a maximum of 2 years, unless you interact with us again, in which case the period is renewed. Once these periods have elapsed without renewal, the data will be deleted or anonymized solely for marketing or profiling purposes, without affecting your Club membership.

During the business relationship, until deletion is requested, and for the periods legally required for tax purposes

Data collected for the Loyalty Program

Data related to the loyalty card will be retained while the program remains active, or until you request its deletion, except for legal reasons.

 
In France, data will be retained for 3 years from the last interaction, purchase, login or contact with us, unless there is a legal obligation to retain it for longer or you exercise your rights; once this period has elapsed, your data will be deleted or anonymized, without affecting your membership card: simply reactivating it will resume the count. 


In Italy, data processed with your consent for marketing purposes is retained for a maximum of 1 year from its collection or from the last interaction; data processed for profiling purposes is retained for a maximum of 2 years, unless you interact with us again, in which case the period is renewed. Maximum period of 30 days, except for security reasons.

They will be retained for a maximum of 1 year from receipt, after which they will be deleted, unless the candidate renews their consent or is hired.

Whistleblowing channel

The data will be retained for the time strictly necessary to decide whether to initiate an investigation into the reported facts. In any event, three (3) months after receipt of the report, if no investigation has been initiated, the data will be deleted, unless it is necessary to retain it as evidence of the system's operation. Under no circumstances will communications and internal investigations be retained for more than ten years.

8. Recipients

As a general rule, we do not transfer or disclose data to third parties, except where legally required, where necessary to manage the sale and purchase and shipment of products (logistics and transport companies), or where third parties provide us with technology services (information storage and processing, security services). We will have entered into the corresponding data processing agreements with them. However, where necessary, such data transfers or disclosures will be communicated to the data subject through the informed consent clauses contained in the different channels used to collect personal data. 

Loyalty Club: in order to accumulate and redeem your points/benefits at any participating MUY MUCHO establishment, your Club data will be consulted and updated by those establishments and by HABITUS GLOBAL RETAIL, S.L.U., all acting on behalf of HABITUS GLOBAL, S.L. and with limited access to the information necessary to manage the Club.

9. International Data Transfers

As a general rule, your data is processed and stored within the European Economic Area (EEA). If any of our technology providers, such as CRM, marketing or web analytics tools, is located outside the EEA, that transfer will always be carried out under an adequacy decision by the European Commission, Standard Contractual Clauses, or any other safeguard permitted under Chapter V of the GDPR.

As a general rule, personal data is always collected directly from the data subject; however, in certain exceptional cases, data may be collected through third parties, entities or services other than the data subject. In this regard, this will be communicated to the data subject through the informed consent clauses contained in the different information collection channels and within a reasonable period after the data is obtained, and no later than one month.

With regard to browsing data that may be processed through the website, if data subject to regulations is collected, we recommend consulting the Cookie Policy published on our website.

12. Minors

Our websites, applications and Loyalty Club are intended for persons[JLC2.1] over 16 years of age. If you are under 16, please do not register or provide your data without the authorization of the person exercising parental authority or legal guardianship. If we discover that we have obtained data from a minor under that age without such authorization, we will delete it as soon as possible.

13. Data subject rights
